Terms of service

(a) By accessing or using the Site, browsing our product offerings, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, as well as any additional policies incorporated herein by reference, including our Privacy Policy. These Terms constitute a legally binding agreement between you and Darling Mahjong.

(b) If you do not agree with any part of these Terms, you must immediately discontinue your use of the Site and refrain from placing any orders. Your continued access to or use of the Site following the posting of any changes to these Terms shall constitute your acceptance of those changes.

(c) We reserve the right to update, amend, or replace these Terms at any time at our sole discretion. When changes are made, we will update the "Last Updated" date at the top of this page. It is your responsibility to review these Terms periodically. Continued use of the Site after changes have been posted constitutes your acceptance of the revised Terms.

(a) To use the Site or place an order with Darling Mahjong, you must be at least eighteen (18) years of age. If you are under the age of 18, you may only use the Site with the involvement and express consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

(b) By using the Site, you represent and warrant that you have the legal capacity to enter into a binding contract under applicable law. You further represent that you are not barred from entering into agreements or receiving services under the laws of any applicable jurisdiction.

(c) Our products and services are not available to individuals or entities where their purchase or use would be prohibited by applicable local, state, national, or international law or regulation. It is your responsibility to ensure that your use of the Site complies with all laws applicable to you.

(a) Darling Mahjong takes great care in presenting accurate and complete descriptions, images, pricing, and availability information for all products listed on the Site. However, we do not warrant that product descriptions, images, pricing, or any other content on the Site are complete, current, reliable, or error-free. In the event that a product is listed with an inaccurate price or description due to a typographical error or system issue, we reserve the right to correct such errors and to cancel any orders placed based on incorrect information.

(b) Please be aware that the colors, textures, and finishes of products displayed on the Site may appear differently on your screen depending on your monitor, device settings, and display calibration. We make every reasonable effort to represent our products accurately, but we cannot guarantee that your display will render colors precisely as they appear in person. Minor variations in color are not considered defects.

(c) We reserve the right, at our sole discretion, to limit the quantities of any product available for purchase, to discontinue any product at any time without notice, and to restrict sales of products to any person, geographic region, or jurisdiction. Products and pricing are subject to change at any time without prior notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuation of a product.

(a) Orders may be placed through the Site by following the checkout process provided by our Shopify-powered storefront. When you submit an order, you are making an offer to purchase the selected products subject to these Terms. We will send you an order confirmation email upon receipt of your order; however, this confirmation does not constitute acceptance of your order. Order acceptance and the formation of a contract between you and Darling Mahjong occurs at the time we dispatch your products and send a shipping confirmation.

(b) We reserve the right, at our sole discretion, to refuse or cancel any order for any reason, including but not limited to: suspected fraudulent activity, pricing errors, inaccurate product information, failure of payment authorization, or identified stock limitations. If we cancel your order after payment has been collected, we will issue a full refund to your original payment method in a timely manner.

(c) We accept payment via major credit and debit cards (including Visa, Mastercard, American Express, and Discover), PayPal, and Shopify Pay. All payment information is processed securely through Shopify's payment infrastructure. We do not store your full payment card details on our systems. By providing payment information, you represent that you are authorized to use the payment method provided.

(d) Applicable sales tax will be collected on orders where required by law, based on the shipping destination and applicable tax regulations. The amount of sales tax, if any, will be calculated and displayed during checkout prior to order completion.

(e) All transactions on the Site are conducted in United States Dollars (USD). If you are purchasing from outside the United States, your bank or payment provider may apply currency conversion rates and fees, for which Darling Mahjong is not responsible.

(a) Darling Mahjong ships to addresses within the contiguous United States and, where available, to select international destinations. Shipping availability for international locations is subject to change without notice. We will make reasonable efforts to display current shipping destination options at checkout.

(b) Estimated shipping and delivery timeframes are provided at checkout and in your order confirmation email for informational purposes only. These estimates are not guarantees. Actual delivery times may vary due to carrier capacity, weather events, peak seasons, customs processing, or other factors beyond our control. Darling Mahjong shall not be liable for delays in shipping or delivery caused by third-party carriers or circumstances outside our reasonable control.

(c) Risk of loss and title for products purchased from Darling Mahjong pass to you upon our tender of the product to the carrier. Once your order has been handed off to the shipping carrier and a tracking number has been provided to you, Darling Mahjong is not responsible for lost, stolen, or delayed packages that are in the carrier's possession.

(d) You are solely responsible for providing an accurate, complete, and deliverable shipping address at the time of order placement. Darling Mahjong is not liable for packages that are undeliverable, returned, or lost as a result of an incorrect, incomplete, or undeliverable address provided by you. Any additional shipping costs incurred due to address correction or reshipment will be your responsibility.

(e) For international orders, you are responsible for all customs duties, import taxes, tariffs, and any other fees imposed by the destination country's customs authority. These charges are not included in the product price or shipping cost at checkout and are entirely your responsibility. Darling Mahjong has no control over customs processing times or the assessment of such fees.

(a) We want you to love your Darling Mahjong purchase. If you are not completely satisfied, we accept returns on eligible items within thirty (30) calendar days of the confirmed delivery date. To be eligible for a return, items must be unused, unopened, and in their original packaging with all tags, inserts, and accessories intact. Items that have been used, opened, or damaged by the customer will not be accepted for return.

(b) Items marked as "Final Sale," "Clearance," or otherwise designated as non-returnable at the time of purchase are not eligible for return, exchange, or refund under any circumstances, except in the case of a product defect or error on our part as described below.

(c) To initiate a return, please contact us at [[email protected]] with your order number and reason for return. We will provide you with return instructions. Unless the return is due to a product defect, incorrect item sent, or an error on our part, the customer is responsible for all return shipping costs. We recommend using a trackable shipping method, as Darling Mahjong is not responsible for return packages that are lost or damaged in transit.

(d) Once your return is received and inspected, we will notify you of the status of your refund. Approved refunds will be processed to your original payment method within five (5) to ten (10) business days of our receipt and inspection of the returned item. Please note that your bank or payment provider may require additional processing time before the refund is reflected in your account.

(e) If you receive a damaged or defective item, or if you received an incorrect item, you must notify us within seven (7) calendar days of the confirmed delivery date by emailing [[email protected]] with your order number, a description of the issue, and clear photographic evidence of the damage, defect, or incorrect item. Failure to notify us within this window may affect your eligibility for a remedy. For verified defective or incorrect items, we will cover the cost of return shipping and offer a replacement, exchange, or full refund at your election.

(a) All content appearing on or comprising the Site, including but not limited to the Darling Mahjong name, logo, trademarks, trade dress, product photographs, graphic designs, written copy, product descriptions, marketing materials, and the overall look and feel of the Site, is owned by or licensed to Darling Mahjong and is protected by applicable United States and international intellectual property laws, including copyright, trademark, and trade secret law.

(b) You may not reproduce, duplicate, copy, sell, resell, distribute, publish, transmit, display, perform, modify, create derivative works from, or otherwise exploit any content from the Site, in whole or in part, without the express prior written permission of Darling Mahjong. Unauthorized use of our intellectual property may give rise to claims for damages and/or criminal penalties.

(c) If you submit or post content to the Site, including but not limited to product reviews, photographs, comments, or testimonials ("User Content"), you represent that you own or have all necessary rights to such content and that it does not infringe any third-party rights. By submitting User Content, you grant Darling Mahjong a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use, display, reproduce, modify, distribute, and promote such User Content in connection with our business and marketing, including on social media and our Site, without any obligation of compensation or attribution to you.

(a) As a condition of your use of the Site, you agree not to use the Site for any unlawful purpose or in any manner inconsistent with these Terms. Prohibited conduct includes, without limitation:

1. Engaging in any activity that violates any applicable local, state, national, or international law or regulation;
2. Sending unsolicited communications, spam, chain letters, or any other form of unauthorized advertising or promotional material;
3. Scraping, crawling, data mining, or using any automated means to access, collect, or copy content from the Site without our express written consent;
4. Attempting to interfere with, disrupt, or damage the proper functioning of the Site, its servers, or associated networks;
5. Impersonating any person or entity, or falsely representing your affiliation with any person or entity;
6. Uploading, transmitting, or distributing any virus, worm, malicious code, or any software intended to damage or alter the functionality of the Site or any user's system;

These links are provided solely for your convenience and informational purposes. We have no control over the content, privacy practices, or policies of any third-party site and accept no responsibility for them. The inclusion of any link on the Site does not constitute our endorsement of that site or any of its content. We encourage you to review the terms of service and privacy policies of any third-party sites you visit.

(b) Our Site and storefront are powered by Shopify Inc. As a result, certain aspects of your interaction with the Site — including the checkout process, payment processing, and account management — are facilitated through Shopify's platform. By using our Site, you acknowledge that you are also subject to Shopify's Terms of Service and Privacy Policy, which govern Shopify's collection and use of your data. Darling Mahjong is not responsible for Shopify's practices and encourages you to review Shopify's policies directly.

(a) THE SITE AND ALL PRODUCTS, CONTENT, AND SERVICES OFFERED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DARLING MAHJONG EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

(b) Darling Mahjong does not warrant that the Site will be available at all times, uninterrupted, timely, secure, or error-free, or that defects in the Site will be corrected. We do not warrant that the results obtained from using the Site will be accurate or reliable. We reserve the right to suspend, discontinue, or modify the Site or any portion thereof at any time without notice.

(c) No advice or information, whether oral or written, obtained from Darling Mahjong or through the Site shall create any warranty not expressly made herein. Some jurisdictions do not allow the exclusion of implied warranties; in such jurisdictions, the above exclusions apply to the fullest extent permitted by law.

(a) TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DARLING MAHJONG, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, COST OF SUBSTITUTE GOODS OR SERVICES, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, PRODUCTS, OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(b) IN NO EVENT SHALL DARLING MAHJONG'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCTS OR SERVICES PURCHASED THROUGH THE SITE EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO DARLING MAHJONG FOR THE SPECIFIC ORDER OR PRODUCT GIVING RISE TO THE CLAIM.

(c) Some states or jurisdictions do not allow the limitation or exclusion of liability for certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

(a) You agree to defend, indemnify, and hold harmless Darling Mahjong and its owners, officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (i) your use of or access to the Site; (ii) your violation of any provision of these Terms; (iii) your violation of any applicable law or regulation; (iv) your infringement or misappropriation of any intellectual property or other rights of any third party; or (v) any User Content you submit to the Site.

(b) We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate fully with us in asserting any available defenses.

(a) These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to its conflict of law provisions or principles that would cause the application of the laws of any other jurisdiction.

(b) Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site or purchase of products (a "Dispute") by contacting us at darlingmahjong.com and engaging in good-faith negotiation for a period of at least thirty (30) calendar days from the date of written notice of the Dispute. We will make reasonable efforts to resolve the matter informally.

(c) If a Dispute cannot be resolved through good-faith negotiation within thirty (30) days, it shall be finally settled by binding individual arbitration administered in Cook County, Illinois, in accordance with the rules of a mutually agreed-upon arbitration body. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

(d) CLASS ACTION WAIVER: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND DARLING MAHJONG EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. If a court or arbitrator finds this waiver unenforceable with respect to any Dispute, then the arbitration provision shall not apply to that Dispute, and such Dispute shall be resolved in a court of competent jurisdiction in Cook County, Illinois.

(a) Darling Mahjong reserves the right to modify, revise, or update these Terms at any time and for any reason, at our sole discretion. When we make changes, we will update the "Last Updated" date displayed at the top of this page. We may also, at our discretion, provide additional notice of material changes, such as an email notification to registered account holders or a prominent notice on the Site.

(b) Your continued access to or use of the Site, or any purchase of products through the Site, after any revised Terms have been posted constitutes your binding acceptance of those changes. If you do not agree to the revised Terms, your sole and exclusive remedy is to discontinue your use of the Site. We encourage you to review these Terms periodically to stay informed of any updates.
